These Terms of Service ("Terms") govern your access to and use of the ServEaseNow mobile application and the website at serveasenow.com (together, the "Service"), operated by Plenitude Systems Pvt. Ltd. ("ServEaseNow", "we", "us", "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- Consumer — a user who posts a Request for Quote (RFQ) for a service.
- Provider — a verified user who offers services and submits quotes against RFQs.
- RFQ — a structured service enquiry posted by a Consumer.
- Quote — a Provider's price + inclusions response to an RFQ.
- Award — a Consumer's selection of one Provider's Quote.
- Escrow — an optional advance payment held by Razorpay until the job is confirmed complete.
- Platform Fee — fees we charge as described in Section 8.
2. Eligibility
To use the Service you must:
- Be at least 18 years old.
- Be a resident of India and capable of entering into a binding contract under the Indian Contract Act, 1872.
- If signing up as a Provider, complete Aadhaar-based KYC and any additional verification we may require, including bank account verification for escrow-eligible payouts.
3. Our role: intermediary
ServEaseNow is an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. We provide a platform for Consumers and Providers to discover one another and transact. We are not a party to the underlying contract for services, do not perform the services ourselves, and do not warrant the quality or completion of any service.
Provider verification (KYC, photo review, ratings) is a trust signal, not a guarantee. You are responsible for your own due diligence before engaging any Provider, particularly for high-value bookings.
4. Your account
- You must provide accurate and current information when creating an account, and keep it updated.
- You are responsible for all activity that occurs under your account. Keep your phone, email, and device secure.
- You may not create multiple accounts, impersonate another person, or use the Service on behalf of someone who has been suspended.
- We may suspend or terminate accounts for breach of these Terms — see Section 13.
5. Consumer responsibilities
- Submit RFQs truthfully. Do not post fake enquiries, abusive content, or requests for unlawful services.
- Respond to Providers in a reasonable time. Repeated no-shows after awarding a Quote may lead to suspension.
- Pay agreed amounts promptly. Disputed amounts must be raised through the in-app dispute flow within 48 hours of completion.
- Post reviews honestly. Reviews that are abusive, defamatory, paid-for, or unrelated to a completed job may be moderated or removed.
6. Provider responsibilities
- Complete KYC truthfully. Misrepresentation grounds for permanent ban.
- Provide accurate quotes — price, inclusions, validity, and timing.
- Respond to dispatched RFQs within the SLA window for your category (default 2 hours). Persistent non-response affects your ranking.
- Show up for awarded jobs. Two no-shows in 30 days will hide you from search; three will delist you.
- Honour the quoted price for the agreed scope. Scope changes must be agreed via in-app chat before billing.
- Do not solicit consumers off-platform to avoid Platform Fees. Doing so may result in suspension and forfeiture of pending payouts.
- Maintain valid bank account details for payouts.
7. RFQ + Quote flow
The platform mediates the standard flow:
- Consumer posts an RFQ.
- Our match engine dispatches it to up to 8 verified Providers in the catchment.
- Providers submit Quotes within the SLA window.
- Consumer reviews Quotes, optionally chats with Providers, and Awards one Quote.
- Once Awarded, only the chosen Provider can chat further with the Consumer; the others are marked closed.
- The Consumer or Provider marks the job complete; the other confirms.
- Mutual ratings + reviews follow.
Quotes that fall outside our learned price band (calibrated per subcategory) are auto-flagged for moderation. Held quotes are not visible to the Consumer until our team releases them.
8. Payments, fees, and escrow
8.1 Provider subscription tiers
Providers may subscribe to Silver (₹299 / month) or Gold (₹999 / month) tiers for additional features (higher rank, more photos, analytics). Free tier provides limited leads per month. Subscriptions auto-renew via Razorpay until cancelled.
8.2 Pay-per-lead
For specific high-value categories (real estate sale, wedding catering above ₹50,000, construction above ₹5 lakh), Providers may be charged per qualified lead at rates disclosed in-app at the time of Quote submission. Lead charges are billed monthly via Razorpay.
8.3 Escrow
For high-value bookings, a Consumer may pay an advance into escrow. Funds are held by Razorpay (a regulated payment aggregator) and released to the Provider's verified bank account on Consumer confirmation of job completion, or after our dispute resolution process. We may deduct a Platform Fee of 1–2% of the escrow amount, as disclosed at the time of escrow creation.
8.4 No service guarantee
Payment of fees does not entitle a Provider to a specific lead or a Consumer to a specific outcome. We use commercially reasonable efforts to operate the matching engine fairly, but make no guarantees of revenue, lead volume, or service quality.
9. Disputes
- Either party may raise a dispute via the in-app "Report" flow within 48 hours of job completion (or expected completion).
- We will gather the chat transcript, Quote details, and payment record, and attempt mediation within 7 working days.
- For escrow-held funds, our decision determines the release / refund split. The decision is documented in the audit log and shared with both parties.
- Our mediation does not preclude either party from seeking remedy through Indian courts. See Section 17 for governing law and jurisdiction.
10. Reviews
Reviews are limited to one per RFQ per Consumer, and only after job completion is marked. Providers have a right of reply. We may remove reviews that violate community guidelines (profanity, off-topic, paid, defamatory). Removal is logged in our audit trail.
11. Prohibited conduct
You may not, and may not permit any third party to:
- Use the Service for any unlawful purpose, or in violation of any applicable Indian law.
- Post content that is hateful, harassing, fraudulent, sexually explicit, infringing, or unlawful.
- Attempt to reverse-engineer, decompile, or interfere with the security of the Service.
- Scrape, harvest, or otherwise extract Provider or Consumer data in bulk.
- Use the Service to compete with us (e.g., to build a parallel directory).
- Misrepresent your identity or affiliation.
12. Intellectual property
The ServEaseNow name, logo, ServEaseNow mark, the worker illustration, and all software, designs, copy, and trade dress are the property of Plenitude Systems Pvt. Ltd. You receive a limited, revocable, non-transferable licence to use the Service for its intended purposes only.
Content you post (photos, RFQ payloads, reviews) remains your property. By posting, you grant us a worldwide, royalty-free licence to use, display, reproduce and transmit that content as needed to operate the Service and to enforce these Terms.
13. Suspension and termination
- You may delete your account at any time from the in-app settings. Deletion is governed by the retention schedule in our Privacy Policy.
- We may suspend or terminate your account for breach of these Terms, repeated low ratings (Providers), fraud, or non-payment of fees. Suspended Providers forfeit access to leads; pending payouts are released only after dispute resolution.
- Provisions that by their nature survive termination (Sections 8, 9, 12, 14, 15, 17) survive.
14. Limitation of liability
To the maximum extent permitted by Indian law, our aggregate liability arising out of or relating to the Service is limited to (a) the fees you paid to us in the 12 months preceding the claim, or (b) ₹10,000, whichever is greater. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, even if advised of their possibility.
Nothing in this section limits liability that cannot be excluded under Indian law (e.g., gross negligence, wilful misconduct, fraud).
15. Indemnification
You agree to indemnify and hold harmless Plenitude Systems Pvt. Ltd., its directors, employees, and agents from any claim, demand, or expense (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party right.
16. Force majeure
Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, acts of government, pandemics, war, terrorism, internet or telecom outages.
17. Governing law and jurisdiction
These Terms are governed by the laws of India. Disputes shall first be attempted to be resolved through the in-app dispute mechanism (Section 9). Unresolved disputes are subject to the exclusive jurisdiction of the courts at Kallakurichi, Tamil Nadu. The parties may by mutual written consent elect arbitration under the Arbitration and Conciliation Act, 1996, seated in Kallakurichi, conducted in English or Tamil, with a single arbitrator appointed by us and accepted in writing by you.
18. Changes to these Terms
We may amend these Terms. Material amendments will be notified in-app and by email at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.
